  • End Users– individuals who interact with digital advertisements that are created, served, or optimized through the Climaty Services;
  • General Users– collectively, any individual that accesses or uses the Climaty Services, including website visitors, platform users, and end users, or who otherwise expresses interest in doing so.


This Privacy Policy applies to Personal Information that you may share with us on the Platform. However, this Privacy Policy does not apply to information that You provide to, or that is collected by, any third-party through the Platform, and any third-party sites that You access or use.



In addition to this Privacy Policy, Addendum 1 applies to you if you are a resident of the United States of America (USA), and Addendum 2 applies to you if you are a resident of the European Economic Area (EEA) or the United Kingdom (UK), and Addendum 3 applies to you if you are a resident of the United Arab Emirates (UAE) or the Kingdom of Saudi Arabia (KSA).



The Climaty Services are intended solely for use by businesses and are not designed for personal or individual consumer use. Accordingly, we treat individuals who engage with us regarding our services, including all visitors to our websites and users of the Platform (excluding those who are end users of our customers) as representatives of a business entity and not as acting in a personal capacity.



To the extent that we process Personal Information relating to end users, we do so strictly in our capacity as a service provider or processor, pursuant to our contractual arrangements with our business customers. These customers, which may include advertisers, publishers, and/or their authorized agents, act as the Data Controllers (defined below) of such Personal Information. They determine the purposes and means of processing and may use the information, in accordance with applicable laws, to deliver tailored advertising, measure campaign performance, and improve the relevance and sustainability of the advertising experience for end users. For these purposes, Climaty acts as the data processor.



This Privacy Policy has been designed with these key principles in mind:


  1. To set out the required disclosures about the way we use information that you share with us as users.
  2. To ensure that you understand what Personal Information we collect, what we do, and, most importantly, what we do not do with that Personal Information.
  3. To assume responsibility for protecting your rights and your privacy under this Privacy Policy.

'Personal Information' for residents of India means any data about an individual who is identifiable by or in relation to such data, as defined under the Digital Personal Data Protection Act, 2023 (“DPDP Act”). This includes name, contact details, Aadhaar or other government-issued ID numbers, financial data, biometric data, and digital identifiers such as IP address or advertising IDs.

'Personal Information' for residents of other regions (e.g., APAC or EMEA jurisdictions without comprehensive privacy laws) means any information that can reasonably be used to identify, contact, or precisely locate an individual, including but not limited to name, phone number, postal address, email address, and similar identifiers.

'Data Controller' means the person or organization including a data fiduciary that, alone or jointly with others, determines the purposes and means of processing Personal Information.

'Personal Data Breach' means any unauthorised processing of Personal Information or accidental disclosure, acquisition, sharing, use, alteration, destruction or loss of access to Personal Information, that compromises the confidentiality, integrity or availability of Personal Information.



1. Information we collect/receive



Climaty may collect the following Personal Information either to provide the Climaty Services or in the manner prescribed by a Data Controller or where you provide your consent:

  1. Personal Information you provide to help us optimize and decarbonize your campaigns including but not limited to campaign objectives, audience parameters, creative assets, and any inputs related to sustainability goals or carbon reduction preferences;
  2. Personal Information we need to operate your Climaty account and deliver services including but not limited to name, business email, company details, login credentials, billing information, and campaign setup data; and
  3. Personal Information collected from user interactions with our website / platforms or ads delivered through Climaty (hereinafter referred to as "ad" or "ads") including but not limited to device type, IP address, browser, ad impressions, clicks, conversions, location data and estimated carbon footprint associated with ad delivery.


Personal Information collected is either by consent or performance of a contract/agreement with you, or on behalf of a Data Controller and/ or for any pre-contractual obligations thereof. This Personal Information includes, but is not limited to, name, email id, address, and contact number and shall be deemed to disclosed willingly and without any coercion. Further, no liability pertaining to the authenticity/ genuineness/ misrepresentation/ fraud/ negligence of the Personal Information disclosed shall lie on Climaty nor will Climaty be in any way responsible to verify any information obtained from you. In the event you are aware of any changes or inaccuracies in your Personal Information, you should inform Climaty of such changes so that our records may be updated or corrected.

When you provide Personal Information directly to us, this information is used by Climaty solely for the purposes identified at the point you provide it.

You acknowledge and agree that You are responsible for ensuring that the Personal Information You provide is accurate, complete and current and that You will co-operate with Us to ensure that such Personal Information is complete, accurate and consistent till such time that such Personal Information is processed by Us.

You also agree that all the information shared by You with the Company is lawful, true and correct and does not violate or infringe any applicable laws. In case of any violations, infringement, or furnishing of wrongful or unauthorized information, the Company shall not be liable to You or to any third party for the same.

You acknowledge that if We determine that any information You have provided violates the terms of this Privacy Policy, We have the right, in Our absolute discretion, to delete or destroy such information without incurring any liability to You.



2.How we use that information

We collect, transfer (if required), store, use, and/or process the information either to provide the Climaty Services or in the manner prescribed by a Data Controller or where you provide your consent as follows:

Contact information When you interact with Climaty by submitting forms on our website, registering for events, or using our platform we may collect Personal Information such as your name, email, organization, and contact number. With your consent, we may use this information to send you marketing materials, product updates, event invitations, and research communications. Platform users may also receive service-related notifications. You can opt out of marketing emails at any time by using the unsubscribe link or contacting us directly.

Billing information To access certain Climaty services, you may be required to provide additional information such as your name and credit card details. This information is used solely to process payments. In some cases, Climaty engages trusted third-party payment processors to handle transactions on our behalf, in accordance with applicable data protection and security standards. Where we engage third-party payment processors, they may also process your Personal Information independently of this Privacy Policy. User activity data We automatically collect certain Personal Information such as IP address, browser type, device details, pages visited, time spent, and referral URLs when you visit our website or use the Climaty platform (“User Activity Data”). This data helps us monitor usage trends, improve functionality, and enhance your experience. Where such data is considered Personal Information under applicable laws, we process it in compliance with relevant data protection requirements.

Service data To support the delivery of Climaty services and ad serving, we collect limited system connection Personal Information such as end users’ IP addresses (“Service Data”). This data is used to maintain platform performance and security, detect fraud, and troubleshoot ad delivery issues.

Ad interaction data We may receive and process certain interaction data on behalf of our customers—such as advertisers, publishers, or their agents. This may include ad views, clicks, video plays, time spent, IP address, device ID, GPS location, advertising identifiers (IDFA/AAID), and any information voluntarily submitted via ad forms (“Ad Interaction Data”).

Cookies and similar technologies Climaty and its partners use cookies and similar technologies to enhance website functionality and personalize ad experiences for end users. In connection with the Climaty services, cookies may be used to infer user preferences, serve relevant ads, and measure campaign effectiveness. Some third parties may combine this data with information collected across other websites or apps under their own privacy policies. Where used on behalf of a customer, Climaty’s cookies will not persist for more than ninety (90) days, unless renewed upon subsequent interaction.

Purposes for which we seek your consent We may also ask for your consent to use your Personal Information for a specific purpose that we communicate to you.

Purposes which are legitimate under law We may use your Personal Information for certain legitimate uses or legitimate purposes as permitted by applicable laws.



3.Data retention

Climaty may retain your Personal Information only for as long as necessary to fulfil the relevant purposes set out in this privacy policy, as may be required by law or as otherwise communicated to you. You hereby acknowledge that Climaty may retain and use your Personal Information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies as permitted by applicable laws. How long we retain specific Personal Information varies depending on the purpose for its use, and we will delete your Personal Information in accordance with applicable law(s). Climaty will also retain User Activity Data for internal analysis purposes. Customers
We may share user activity and ad interaction data with Climaty’s customers such as advertisers, publishers, or their agents for their legitimate advertising purposes, including to deliver more personalized ad experiences. Such sharing is done in accordance with our contractual obligations and customers’ instructions.

Third-party service providers
Climaty engages trusted third-party service providers to support the delivery and operation of our services. This includes billing, analytics, customer and technical support, hosting, and marketing functions. These providers are contractually obligated to handle your Personal Information securely and in compliance with applicable data protection laws.

Legal obligations
We may disclose your Personal Information to law enforcement, regulatory authorities, courts, or other authorized parties if required to do so under applicable laws, regulations, or legal processes.

Business transfers

Security measures Climaty implements reasonable technical and organizational safeguards to protect Personal Information collected through our website and services. While we strive to maintain a secure environment, no system is completely secure. We cannot guarantee that unauthorized access, disclosure, or misuse will never occur, nor can we control how third parties handle Personal Information you choose to share with them. Accordingly, we disclaim liability for any unauthorized access beyond our reasonable control.

Personal data breach notification In the event of a personal data breach that compromises your information, Climaty will notify affected individuals and relevant supervisory authorities within 72 hours or otherwise, where required by law. The notification may include details of the breach, the data involved, any service impact, and the measures taken to address the breach and mitigate harm.



6.Where do we store the information

This is an Important Notice.

Climaty’s servers are located in Mumbai, India. As part of our global operations, your Personal Information may be transferred to and processed in countries outside of your jurisdiction, unless restricted by applicable laws. Where such transfers occur, we implement appropriate safeguards to protect your data in accordance with this Privacy Policy and applicable laws in the country of origin.

Consent to international transfers If you are located outside India, please note that your Personal Information will be transferred to India for the purpose of delivering Climaty services. By providing your information to us or using our services, you expressly consent to this transfer and processing. Where required under applicable laws, continued use of the Climaty platform will be considered your consent to such cross-border processing.

8.Trusted Third-Party Solutions Providers

Climaty engages trusted third-party providers who maintain strong security practices aligned with recognized IT security standards, including SOC 2 and ISO 27001. We currently use AWS Cloud and Google Workspace (G-Suite) solutions to support service delivery. Any material changes to these third-party providers will be reflected in future updates to this Privacy Policy.



9.Sale of Personal Information

Climaty does not sell the Personal Information collected for commercial purposes or disclose Personal Information to third parties for direct marketing purposes.



10.Children's Privacy

The Climaty website and services are not intended for individuals under 18 years of age. We do not knowingly collect Personal Information from anyone under 18. If you are under 18, please do not use the Climaty services or submit any Personal Information.   • Notice regarding the processing of your Personal Information, the categories and purposes of Personal Information being processed, and the identities of all other third-party entities with whom your Personal Information has been shared by us, along with a description of the shared Personal Information, except when it is pursuant to a written request by such third-party entity for the purpose of prevention or detection or investigation of offences or cyber incidents, or for prosecution or punishment of offences.

  • To give, manage, review or withdraw your consent provided to Climaty to process your Personal Information through a ‘consent manager’. A consent manager may be an entity that is registered with the Indian Data Protection Board. The consent manager is accountable to you and can assist you in providing or withdrawing your consent to us to process your Personal Information on your behalf. Such consent managers must comply with the obligations imposed on them as may be prescribed by the Indian government.
  • The right to withdraw your consent in connection with any of your Personal Information that has been obtained by consent. In such a scenario, you are requested to not access Climaty’s website or platform or avail the Climaty Services and we reserve the right to not provide you any Climaty Services. Climaty may delete your Personal Information or de-identify it so that it is anonymous and not attributable to you. If Climaty retains the Personal Information after withdrawal of your consent, we shall retain it only for the period required by or permitted under applicable laws.
  • You may also utilize Climaty’s grievance redressal mechanism in connection with any of your Personal Information processed directly by us.
